Terms and conditions

1. Who provides the service
The service is provided by Malatacca Ottavio, based at Via Nino Bixio 33, 98123 Messina (ME), Italy. For any communication: [email protected], telephone +39 366 497 7429.
2. Scope
The service consists of video editing and animated graphics as described by the packages on this site. Each package states the number of deliverables, the formats, the turnaround and the number of revisions included: those statements form part of the contract.
3. Formation of the contract
The contract is formed when payment for the chosen package clears. From that moment you receive a confirmation and access to your order panel.
4. Material supplied by the customer
The customer uploads the material required for the work and warrants that they are entitled to use it: either owning the rights or holding the necessary permissions, including those of any people filmed. The customer indemnifies the provider against third-party claims relating to the supplied material.
Unlawful or defamatory material, material infringing third-party rights, or material depicting minors without the consent of their guardian, is not accepted.
5. Turnaround
Stated timeframes are in working days and start from receipt of the complete material, not from payment. If material is incomplete the clock is suspended until it is supplied.
6. Revisions
Each package includes the number of revisions stated on its card. A revision means one cycle of changes requested in a single communication. It covers changes to the edit, the copy, the music and the colour grade. Changes of creative concept, or requests requiring new filming, are not revisions: those are agreed as additional work.
7. Prices and payment
The price shown on each package card is the final price: nothing is added at checkout. Payment is taken in advance through SumUp, which issues the transaction receipt. The provider neither processes nor stores card data.
8. Rights in the delivered videos
Once paid for and delivered, the customer acquires the right to use the work without limit of time, territory or platform, advertising use included. Any music and stock elements included are licensed for commercial use.
Unless the customer asks otherwise, the provider may show the work in its own portfolio.
9. Withdrawal
Consumer withdrawal terms are set out on the dedicated page.
10. Liability
The provider is liable in accordance with applicable law. Liability is excluded for lost profits or commercial results expected from publishing the videos, which depend on factors outside the service.
11. Governing law and jurisdiction
Italian law applies. For consumers, the court of their place of residence has jurisdiction; otherwise the court of Messina.
